These Terms & Conditions (“Terms”) govern your access to and use of Get CV Upgrade (the “Service”), operated by Execuro UG (haftungsbeschränkt), a company registered in Berlin, Germany (HRB 279608 B) (“we”, “us”, “our”).
By creating an account or purchasing a plan, you agree to these Terms and our Privacy Policy. The Service provides AI-powered tools for CV review and improvement. We do not guarantee job interviews, employment, or any specific performance results.

Right of Withdrawal (EU consumers)
If you are a consumer residing in the European Union, you have the right to withdraw from this contract within 14 days without giving any reason. To exercise this right, please contact us at contact@getcvupgrade.com. However, if you start using the Service immediately after purchase, you expressly agree that the digital content will be provided before the withdrawal period ends and acknowledge that your right of withdrawal expires once the Service is fully performed.

Your use of the Service is subject to our Privacy Policy, which forms part of these Terms. We process data under the GDPR, German BDSG, and Canadian PIPEDA / Québec Law 25.
By using the Service, you consent to international transfers of your data under Standard Contractual Clauses (SCCs) and vendor DPAs (OpenAI, Heroku/AWS, Stripe, Mailgun, Brevo).
9. Governing Law & Jurisdiction
These Terms are provided in English. In case of any discrepancy between translated versions and the English version, the English version shall prevail.

You may cancel your subscription at any time via your account dashboard; cancellation takes effect at the end of the billing cycle.
We may suspend or terminate your account if you breach these Terms, fail to pay, or engage in abuse or unlawful activity.
Upon termination, data is deleted or anonymized per our retention policy (see Privacy Policy).
11. Changes to These Terms
We may revise these Terms from time to time. Updates will appear on our website and take effect when posted. If changes materially affect your rights, we will notify you by email or in-app notice at least 7 days before they take effect. Continued use after such date constitutes acceptance.

2. Eligibility & Use Restrictions
- You must be 18 years or older to use the Service.
- The Service is for personal job-seeking use only. Bulk or commercial use (e.g., by recruiters, agencies, or enterprises) is not permitted without prior written agreement. Please contact contact@ getcvupgrade.com for commercial licensing.
- You agree not to interfere with, copy, reverse-engineer, or resell any part of the platform, its code, or templates.
3. Accounts & Registration
- To use the Service, you must create an account with a valid email address.
- You are responsible for maintaining the confidentiality of your login credentials.
- You may delete your account at any time. Deletion requests will be handled in accordance with our Privacy Policy.
- We may suspend or terminate accounts that violate these Terms.
4. Subscriptions & Payments
- The Service is provided as a subscription SaaS, available on monthly, one-off or yearly plans.
- A free plan (if available) has limited features and data retention (30 days).
- Paid subscriptions renew automatically until canceled.
- Payments are processed securely through Stripe.
- Refunds are available if you provide a valid reason for dissatisfaction within 14 days of purchase, in line with EU consumer law.
- By subscribing, you agree that access to digital content begins immediately, and you may lose your statutory right to withdraw after full use of the Service.
- You may request a refund within 14 days of purchase if you have not fully used the digital content.
- By starting to use the Service immediately after purchase, you acknowledge and agree that the statutory EU right of withdrawal for digital content no longer applies once performance has begun.
- Refunds beyond this period are at our discretion.

5. Intellectual Property
- You retain ownership of your own content, including your CV and uploaded information.
- We grant you a non-exclusive, non-transferable license to use our platform and download CVs in available templates for personal use.
- You may not copy, redistribute, or commercially exploit our software, algorithms, or CV templates.
- We may use anonymized and aggregated data to improve our services, but we will not claim ownership of your personal data or CV.
- The Service uses AI technology (via OpenAI API) to analyze CVs and provide recommendations.
- Portions of your CV may be transmitted securely to third-party providers for processing.
- Results are generated automatically and serve as advisory suggestions only; users remain responsible for reviewing and validating their CVs before use.
7. Disclaimer & Limitation of Liability
The Service is provided “as is” for informational and advisory purposes.
To the extent permitted by law:
- Our total liability is limited to the amount you paid in the preceding 12 months.
- We are not liable for indirect, incidental, or consequential damages (including loss of income or opportunities).
- Nothing in these Terms limits liability for intent, gross negligence, or mandatory consumer rights under EU or Canadian law.
